1. Introduction
These Terms & Conditions ("Terms") apply to the supply of services and goods by GoGeeks Pty Limited (ABN: 87 676 130279) (“GoGeeks,” “we,” “us,” or “our”) to the customer (“you” or “your”). By engaging GoGeeks to provide any services or goods, including on-site services, you agree to these Terms.
2. Definitions
- "Goods" refers to any products, hardware, software, or other materials supplied by GoGeeks.
- "Services" refers to the IT solutions and tech services provided by GoGeeks, including but not limited to computer repairs, setup, installation, maintenance, custom PC builds, troubleshooting, data recovery, and remote support.
- "Onsite Services","Onsite Support" refers to any services provided at your premises or location as requested.
- "Fees" refers to the charges for each onsite visit, which include a minimum onsite fee of $158.00 (including GST) for the first hour. If additional time is required, $79.00 (including GST) will be charged for every 30 minutes beyond the initial hour.
- "Agreement" means the contract formed when you accept our offer to provide goods or services, governed by these Terms.
3. Scope of Services
3.1 Services Offered
We provide a comprehensive range of IT solutions, including:
- On-site and remote IT support.
- Computer repairs, maintenance, and troubleshooting.
- Installation and setup of hardware, software, printers, and WiFi networks.
- Virus, spyware, and malware removal.
- Data backup, recovery, and transfer.
- Network and internet troubleshooting.
- Managed IT Services (MSP) agreements.
- Business NBN Services
3.2 Set-Up Services
- Computer Setup: Includes software installation, updates, and initial configurations.
- Printer Setup: Installation, connection, and driver setup.
- NBN / WiFi Network Setup: Router configuration, security settings, and device connections.
- Software Setup: Installation, licensing, and basic configuration of approved software.
3.3 Same-Day Service
Same-day service is available, subject to technician availability and service location. No additional fees are charged for expedited same-day service requests.
3.4 Weekend & Public Holiday Call-Outs
Additional charges apply for services requested on weekends or public holidays.
3.5 Service Areas
Additional travel fees may apply for locations outside standard service areas.
4. Business Hours
- Remote & On-Site Support
- Monday to Friday: 8:00 AM to 8:00 PM (AEST)
- Saturday: 10:00 AM to 6:00 PM (AEST)
- Sunday: 10:00 AM to 5:00 PM (AEST)
- Public Holiday: 10:00 AM to 6:00 PM (AEST)
5. Service Agreement
5.1 No Fix, No Fee Policy
- For on-site services, we guarantee that we can find a solution to your problem or we won’t charge you for the on-site service fee.
- Diagnostic fees may apply regardless of repair outcome.
- If a repair is declined after diagnosis, the diagnostic fee remains payable and is non-refundable.
- Certain services are non-refundable, including software troubleshooting and system assessments.
5.2 Approval of Repairs
- Repairs will not proceed without your explicit approval.
- Additional costs discovered during the repair process will be communicated, and work will only continue with your consent.
5.3 Diagnosis and Quotation
- An initial diagnosis and quotation for repairs will be provided.
- If you decline the quotation or repairs are not possible due to unavailable parts, a diagnostic fee may apply.
5.4 On-Site Services Duration & Charging
- On-site services are charged at a minimum of one hour.
- After the first hour, charges are calculated in 30-minute increments.
5.5 On-Site Service Obligations
- You must provide safe and appropriate access to your premises for on-site services.
- Our technicians may require return-to-base service for complex issues that cannot be resolved on-site.
5.6 Access to Systems and Data
- By engaging us, you authorize GoGeeks to access your computer, system, and data as necessary to perform the services.
5.7 Data Backup Obligation
- You are responsible for ensuring your data is backed up before we begin any service.
- GoGeeks accepts no liability for data loss.
6. Acknowledgements and Disclaimers
6.1 Service Time frames
Time frames provided are estimates only and subject to change based on the complexity of the issue.
6.2 Recommendations
Our technicians may recommend upgrades or replacements. These recommendations are based on current assessments but are not guaranteed to resolve all issues.
6.3 Limitations
- Not all issues can be resolved by remote support.
- Certain issues may require follow-up visits or return-to-base services.
- Some problems may not be identified during the initial diagnosis.
6.4 Customer Responsibility
Failure to follow our instructions or advice may result in unresolved issues or additional costs.
7. Payment Terms
7.1 Service Fees
Fees for on-site & remote services and other tasks are payable immediately upon service completion.
All fees are inclusive of GST.
7.2 Additional Charges
Additional fees apply for same-day services, weekend call-outs, and public holiday services.
7.3 Payment Methods
Payment can be made via debit/credit card or bank transfer, as provided at the time of booking and or after job done.
By booking or purchasing, you authorize us to debit the specified account for fees due.
8. Cancellations and Rescheduling
8.1 Cancellations
Cancellations require at least 24 hours’ notice. If less than 24 hours' notice is provided, a cancellation fee may apply, equivalent to the cost of the first hour of onsite service to compensate for lost time and expenses.
8.2 Rescheduling
Appointments may be rescheduled with at least 24 hours' notice. Late changes may incur additional fees, equivalent to the cost of the first hour of onsite service to compensate for lost time and expenses.
9. Privacy
We comply with the Privacy Act 1988 and are committed to protecting your personal information. Refer to our Privacy Policy for details on how we handle data.
10. Liability
10.1 Goods
GoGeeks supplies goods in compliance with Australian Consumer Law. If goods are faulty or not as described, remedies include repair, replacement, or refund.
10.2 Services
We warrant services are provided with due care and skill. Our liability is limited to the cost of re-supplying the service or refunding fees, as permitted by law.
10.3 Limitations
GoGeeks is will not be liable to you (whether in contract, negligence or otherwise) for any:
- Indirect, incidental, or consequential losses (e.g., data loss, business disruption).
- Interruption of business.
- Loss of revenue, profits, or business reputation.
- Delays or service disruptions.
- Loss, alteration, or corruption of data, software or media.
- Viruses or system failures.
- Events beyond our reasonable control.
- Issues resulting from third-party software or hardware.
11. Termination and Suspension
GoGeeks reserves the right to terminate or suspend services if:
- You fail to comply with these Terms.
- Outstanding fees remain unpaid.
- Issues arise beyond our reasonable control (e.g., safety concerns).
12. Changes to Terms
We may update these Terms at any time. The latest version will be available on our website, and it is your responsibility to review them periodically.
